Terms of Service and Platform Usage Agreement

By accessing or using the Sobuh platform ('Sobuh', 'we', 'us', or 'our'), whether as a customer, creator, or visitor, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease using the platform. Users must be at least 18 years of age or have legal parental consent to enter into binding transactions.

To access marketplace features, customers and creators must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, truthful, and complete information during registration and keep your account profile updated.

Creators may publish service session packages, physical items, and downloadable digital assets. Creators warrant that all listing descriptions, prices, lead times, availability, and images are accurate and non-misleading. Creators must not list prohibited items including illegal goods, counterfeit items, weapon accessories, or dangerous materials.

When a customer initiates checkout for a service booking or physical product order, the transaction is processed through our integrated gateway partner (Razorpay Software Private Limited). Prices are calculated server-side from database records. Customers agree to pay the total order amount displayed at checkout.

Sobuh charges a transparent commission structure for facilitating marketplace discovery and commerce operations. Transactions originating directly from a creator's custom link incur a 2.0% platform fee pass-thru, while transactions originating from Sobuh organic marketplace discovery incur a 7.0% platform commission. Applicable GST (18%) is calculated on platform commission fees.

Users are strictly prohibited from: (a) circumventing platform checkout to complete offline cash transactions outside Sobuh; (b) posting fraudulent reviews, ratings, or misleading portfolio images; (c) harassing, spamming, or threatening other users; (d) attempting unauthorized access or IDOR security manipulation.

Creators retain full ownership of their original portfolio artwork, photography, downloadable materials, and brand trademarks. By publishing content on Sobuh, creators grant Sobuh a non-exclusive, worldwide, royalty-free license to display, promote, and format the content for marketplace operations.

Sobuh Technologies Pvt. Ltd. provides the marketplace platform on an 'as-is' and 'as-available' basis. To the maximum extent permitted by law, Sobuh shall not be liable for indirect, incidental, or consequential damages resulting from service delays, product transit defects, or user disputes. Users agree to indemnify Sobuh against claims arising from violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of India. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts located in Bengaluru, Karnataka, India.
